1. Preface
The charter of the Eczema Mailing List ("List") contains important policies
and terms and conditions of participation. People requesting to be subscribed
to the List are informed of the existence of the charter and how to access
it here or to obtain a text copy. By virtue of subscribing to the Eczema
Mailing List, a person stipulates that he or she has read and understands
the charter and agrees to the terms and conditions contained in it.
The List owners may change the terms and conditions for participation
solely at their discretion after notifying current subscribers of the proposed
change and providing them with sufficient opportunity to unsubscribe from
the List before the change is adopted.
2. Purposes of the List
The purpose of the Eczema Mailing List ("List") is to provide a forum for
people with an interest in eczema to exchange information and experiences
in a supportive and positive environment.
It is also the purpose of the List to maintain a repository of the information
shared on the List, so that this collective information is available to
inform and assist future, as well as current, List subscribers.
3. Responsibilities of List Owners and Subscribers
The List owners are responsible for the management and administration of
the Eczema Mailing List ("List"), which includes approving subscription
requests, monitoring the List for adherence to List policies, maintaining
the List archives, and maintaining the List Web site. The List owners are
those people designated in the Listserv header for the List.
A List owner may be removed upon his or her request, or upon the agreement
of all other owners for violating the List policies or for inactivity.
Any person removed as an owner relinquishes any claims of ownership and
any presumed rights thereof.
Important policies regarding the direction, purposes, and administration
of the List are discussed on the List and generally established based on
a consensus of the List subscribers. The List owners, however, are ultimately
responsible for establishing List policies.
Subscribers are responsible for conducting themselves in accordance
with the policies contained in the List charter and the List guidelines.
4. Subscription Criteria
The List is open to all people with a legitimate, non-commercial interest
in eczema who wish to exchange information and experiences with other subscribers.
Subscribers are added to the List by an List owner. Professionals involved
in the treatment or science of eczema are welcome. Subscriptions are not
accepted from those interested only in promoting commercial products or
services, or from organizations of any kind. The decision to subscribe
an individual to the List is solely that of the List owner.
Anonymous subscriptions are not accepted. People requesting to be subscribed
to the List are asked to provide their real first and last names, and the
full name given is used in the subscription. People wishing to subscribe
also must send their request from the e-mail address to be used for the
subscription. The e-mail address should be a private address, that is,
an address that is not shared with a group of people. Web e-mail, such
as Yahoo Mail or Hot Mail, and WebTV addresses are accepted, but subscribers
using those services may not be able to access the List archives for technical
reasons.
5. Moderation
Messages to the List are not moderated, that is, not reviewed by the List
owners prior to being posted. The List is "moderated" primarily by the
subscribers themselves, who have demonstrated uncommon courtesy, good sense,
and mutual respect throughout the history of the List. Subscribers are
expected to help maintain the co-operative and supportive nature of the
List and to adhere to the List posting rules and
guidelines.
Any question about a subscriber's behaviour on the List will be handled
by a List owner in private whenever possible. Repeated failure to adhere
to the List policies or posting rules and guidelines
may result in a subscription being set to REVIEW, a subscription option
that requires messages to be approved by a List owner or moderator prior
to being posted to the List. The interpretation of adherence to the List
policies and acceptable behaviour on the List is solely the determination
of the List owner.
No subscriber will be placed on REVIEW or removed from the List without
first being notified of the behaviour or actions considered unacceptable
and being given the opportunity to correct the problem. The exception to
this rule is if a subscriber's actions are so egregiously offensive or
so threatening to the List that immediate action must be taken.
Private communications among subscribers are not the responsibility
of the List owners. Subscribers should be aware that other subscribers
may obtain their e-mail addresses from messages posted to the List and
that they may receive unsolicited private e-mails from other subscribers.
Subscribers are normally expected to deal with such e-mails themselves,
as they would any other private e-mail. A subscriber may be removed from
the List for harassing, threatening, flaming, or spamming other List subscribers
in private communications, but solely at the discretion of the List owner.
6. List Archives
The List is configured to archive messages in a searchable database. The
List archives are maintained primarily as a service to current and future
subscribers.
All messages to the List are automatically archived on the host computer
and include the author's name and e-mail address. It is not technically
possible for subscribers to choose to have their messages excluded from
the archives.
The List archives may be viewed only by people currently subscribed
to the List. The List owners reserve the right to make the archives public
with the stipulation that all previous archives will be removed at that
time.
7. Permissions Granted by Posting to the List
By virtue of posting a message to the List, a subscriber grants other subscribers
and the List owners the following permissions:

Permission for the message to be distributed to all List subscribers and
for the message to be read, saved, and stored in electronic, paper or any
other media by other subscribers for their own limited, private use. Limited,
private use may include occasionally sharing copies of a message, in full
or part, with individuals who are not List subscribers, but does not include
reposting to other mailing lists, newsgroups, Web sites, or other public
forums without the author's explicit permission.

Permission for the List owners or their designees to maintain a message
in the List archives in perpetuity, provided that access to the List archives
remains restricted to List subscribers only, and to edit a message, as
may be needed to enhance the usability of the List archives. Editing may
include formatting changes, removing extraneous text, such as excessive
quoting, and changing subject lines, but does not include altering the
substance of a message nor correcting grammatical, spelling, and similar
errors.
Note that permission of an author is not needed for a List owner
or designee to remove a message from the archives for any reason. The inclusion
of messages in the archives is solely at the discretion of the List owners.

Permission for the List owners or their designees to reproduce a message,
in full or in part, in non-commercial compilations, research, and similar
works that may be in electronic or other media and that may be made available
to the public, provided that all personal identifying information is removed
and the substance of a message is not altered.
8. Privacy
It should be understood that the Eczema Mailing List is a public
mailing list with several hundred subscribers. Over time, thousands of
people join the List and have access to the List archives and, thereby,
have access to the names and e-mail addresses of anyone who has posted
to the List, as well as any personal information contained in the messages.
It should be further understood that while subscribers are added to
the List by a List owner, the List owners do not verify the identity or
representations of people wishing to subscribe. The List owners cannot
shield a subscriber from any misuse of information readily available to
any subscriber nor from the misconduct of any subscriber.
Access to the list of current subscribers is restricted to List owners.
The list of subscribers will not be provided to any person or entity for
any commercial uses, but may be provided to a person or entity for non-commercial
uses at the discretion of the List owners or as may be required by law.
Access to the List archives is restricted to subscribers, which prevents
the archives from being mirrored on other Web sites or from being indexed
by search engines.
Subscribers are expected to keep personal information about others on
the List strictly confidential. Subscribers should not reveal subscribers'
names, e-mail addresses, or other personal details to anyone not subscribed
to the List. As in any Internet forum, subscribers should exercise due
caution about including personal identifying information about themselves
or their families in messages to the List.
9. Commercial Interests
No commercial promotions of products, services, or treatments are accepted
for posting to the List. Subscribers may not post any offers of a commercial
nature or use their access to the List to e-mail such offers to subscribers
privately. Subscribers may share their experiences, good or bad, with particular
products, and may also explain how and where to get such a product, but
any recommendations should be based on personal experience and phrased
in their own words.
10. Legal Disclaimers
Information and advice shared on the List is not a substitute for professional
medical care. Anyone who has or thinks they have eczema, dermatitis, or
any other health problem should consult a qualified medical practitioner
for diagnosis and treatment. You use information provided in messages to
the List at your own risk. The List owners shall not be held liable for
any harm resulting from the use of treatments, products, services, or any
other information discussed on the List.
The views expressed and information exchanged through the List are solely
the views and information of the subscribers, or the personal views and
information of a List owner posting to the List. The List owners do not
prescreen List messages and make no representations as to the truthfulness,
accuracy, reliability, or safety of information contained in messages sent
to the List, compiled in the List archives, or exchanged privately among
subscribers. Discussion of any treatment, product, service, or publication
is for informational purposes only and should not be interpreted as an
endorsement or recommendation of the List owners.
A subscriber is solely liable for any and all claims arising from copyright
infringement, libel, or any other infringement upon the rights of others
and agrees to indemnify the List owners against any such claims. |
